Scope of Services
1.1 DarylFix provides repair services in respect of Xbox Series S and X, PlayStation 4, and PlayStation 5 controllers.
1.2 Repairs are limited strictly to the rectification of joystick drift by way of desoldering the existing joystick component and installing a TMR or Hall Effect magnetic resonance joystick.
1.3 No additional faults, defects, upgrades, or modifications shall be attended to unless expressly agreed to in writing between DarylFix and the customer prior to commencement of the repair.
Pricing and Payment
2.1 The standard pricing structure is as follows:
2.1.1 R300 for the replacement of a single joystick.
2.1.2 R400 for the replacement of both joysticks.
2.2 All prices are fixed and non-negotiable unless otherwise expressly advertised in writing by DarylFix.
2.3 Full payment shall be due upon completion of the repair, prior to release or return of the device.
Delivery, Courier and Handover
3.1 Customers located outside of Johannesburg shall be responsible for arranging and paying for courier services to and from DarylFix.
3.2 DarylFix shall take reasonable care in packaging repaired controllers for return; however, all risk in transit, including loss or damage, shall pass to the customer upon handover to the courier.
3.3 Local customers may arrange collection and delivery at a mutually agreed location. DarylFix shall not be responsible for any loss or damage occurring during such handover.
Storage and Risk
4.1 Devices submitted for repair shall be stored at DarylFix’s premises.
4.2 While reasonable security measures are implemented, all devices are stored entirely at the customer’s risk.
4.3 DarylFix shall not be liable for any loss, theft, or damage arising from burglary, fire, natural disaster, or any other event beyond its reasonable control.
4.4 The customer expressly indemnifies DarylFix against any claim arising from such loss or damage.
Assessment and Irreparable Devices
5.1 In the event that a controller is assessed and deemed irreparable, no repair fee shall be charged.
5.2 DarylFix may, at its sole discretion, offer to purchase such controller for spare parts at a value determined by it.
5.3 The customer shall be under no obligation to accept such offer.
5.4 Should the offer be declined, the device shall be returned to the customer at the customer’s cost and risk.
Warranty
6.1 DarylFix provides a limited-service warranty of thirty days from date of completion, applicable solely to the specific joystick replacement performed.
6.2 The warranty shall not apply in respect of:
6.2.1 any pre-existing defects or unrelated faults.
6.2.2 damage caused by misuse, negligence, accidental damage, or unauthorised tampering following repair;
6.2.3 any defects arising as a result of courier handling or external factors beyond DarylFix’s control.
6.3 All warranty claims must be supported by valid proof of service.
Limitation of Liability
7.1 The customer acknowledges that controller repairs are invasive in nature and carry inherent risks.
7.2 DarylFix shall not be liable for:
7.2.1 any pre-existing or latent defects;
7.2.2 any consequential or indirect damages;
7.2.3 any loss of data, settings, or accessories.
7.3 To the fullest extent permitted by law, DarylFix’s total liability, whether in contract, delict, or otherwise, shall be limited to the amount paid by the customer for the specific repair service in question.
7.4 Under no circumstances shall DarylFix be liable for any loss of profit, loss of use, or special damages.
Indemnity
8.1 The customer hereby indemnifies and holds harmless DarylFix, its owners, employees, and agents against any claims, damages, losses, or expenses arising out of or in connection with:
8.1.1 the condition of the device submitted;
8.1.2 any failure by the customer to disclose relevant information;
8.1.3 any third-party claims relating to ownership or use of the device.
Customer Obligations
9.1 The customer warrants that all information provided regarding the device, including prior repairs and known defects, is complete and accurate.
9.2 Devices must be collected within fourteen days of notification of completion.
9.3 DarylFix reserves the right to charge reasonable storage fees for any device not collected within the stipulated period.
9.4 Devices not collected within sixty days may be deemed abandoned, and DarylFix reserves the right to dispose of or sell such devices to recover costs, subject to applicable law.
Ownership and Risk Transfer
10.1 Risk in the device shall remain with the customer at all times.
10.2 Ownership of any replaced components shall vest in DarylFix unless otherwise agreed in writing.
Force Majeure
11.1 DarylFix shall not be liable for any delay or failure to perform its obligations where such delay or failure is due to circumstances beyond its reasonable control, including but not limited to acts of God, fire, flood, power outages, or labour disruptions.
General
12.1 These terms constitute the entire agreement between the parties.
12.2 No variation or amendment shall be of any force unless reduced to writing and agreed by both parties.
12.3 Any indulgence granted by DarylFix shall not constitute a waiver of its rights.
12.4 If any provision is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Governing Law and Jurisdiction
13.1 These terms shall be governed by and construed in accordance with the laws of the Republic of South Africa.
13.2 The customer consents to the jurisdiction of the Magistrate’s Court having jurisdiction, notwithstanding that the claim may exceed its monetary jurisdiction.
